PSWP Privilege: Submitting a Subset of Reports

Our hospital would like to submit reports to CHPSO, but wish only to submit medication errors. Do all the safety reports have the Patient Safety Work Product (PSWP) privilege?  

Dear G.B.,

If you wish to submit safety reports as they relate to medication errors, those reports will be privileged PSWP. All remaining reports that are not submitted to CHPSO will not be protected from discovery unless there is another rule applicable, such as peer-review protection or attorney-client privilege. It is highly recommended to document what categories will be reported to CHPSO in your Patient Safety Evaluation System (PSES) to clearly identify which reports are covered.
